Cash benefits and Medicare when you can't work.
Social Security Disability is a federal program providing monthly cash benefits and medical care insurance (Medicare). It can be loosely considered as early retirement for individuals who, because of a chronic medical or mental illness, are not able to work — and for those who have suffered a serious illness or injury that will incapacitate them for at least one year.
Disability Benefits Insurance (DBI) is funded by FICA taxes withheld from the employee's pay; the cash benefit is calculated from the individual's earnings. Supplemental Security Income (SSI) is a federal welfare program for disabled persons who lack the work credits to qualify for DBI. The medical qualification rules are the same for both.
The application is a three-step process. The sooner you have help, the better.
Many deserving people struggle with the complicated process of applying for disability benefits and appealing unfavorable decisions. At Herren Law, we guide our clients through this process and are often the difference between success and failure.
A representative cannot generally speed up the process, but can ensure each step is made timely and that the necessary documentation is on file. Otherwise, the application can become aborted — forcing the applicant to start over and waste valuable time.
Take the application seriously. Once the decision to apply is made, resolve to go the distance and see the process through.

From application to hearing — and beyond.
Initial Application
Apply in person, by telephone, online — or in our office without going to SSA. It usually takes two to three months to receive a reply. If the initial application is denied, the next step begins.
Reconsideration
Request that the claim be reconsidered by filing the appropriate form. We make sure every deadline is met and the file is complete. If reconsideration is denied, we move to the hearing.
Request for Hearing
The most important step. Each applicant has the right to a hearing before an Administrative Law Judge. We prepare your claim well in advance and present your case under the rules of decision the judges follow.
Unfavorable decisions by the Administrative Law Judge can be appealed within the Administration and, if needed, to federal court.
Not every representative is willing, competent, or licensed to take a case that far. Before engaging one at any level, make sure yours is ready, capable, and licensed to see your case all the way through.
Counsel you can stand behind.
