The appeal process

Four levels to fight a denial.

  1. 01Reconsideration
  2. 02Hearing by an administrative law judge
  3. 03Review by the Appeals Council
  4. 04Federal Court review

The first step is the "Reconsideration" level. To begin, you'll need to complete a Request for Reconsideration, Form SSA-561 — also available online through the Social Security website.

Eligibility

What conditions qualify for Veterans Disability?

Physical conditions

A current physical condition resulting from an accident, injury, or illness during your time in service may qualify for service-connected veterans disability benefits or veterans compensation.

Mental conditions

A current severe mental condition that in any way results from your time in service — including PTSD and many others — could make you eligible for service-connected disability benefits.

Pre-existing, aggravated

A current physical or mental condition that pre-dated your service and was aggravated while in service may also qualify you for service-connected benefits.

Additional notes

There are different rules depending on factors such as Prisoner of War (POW) status, Gulf War service, and radiation exposure. The U.S. Department of Veterans Affairs offers additional resources online.
